Davacı DSİ Genel Müdürlüğü vekili tarafindan mahkememizde açmış olduğu yukarıda esas sırasına kaydı yapılan davada; Bartın ili, Merkez ilçesi, Gerişkatırcı Köyü, 114 ada, 285 parsel, 286 parsel, 383 parsel, 384 parsel sayılı taşınmazda hissenizin bulunduğu, 285 parsel sayılı taşınmazın 203,91 m2’lik kısmının mülkiyet, 286 parsel sayılı taşınmazın 78,96 metrekarelik kısmında geçici irtifak, 383 parsel sayılı taşınmazın 164,44 metrekarelik kısmında mülkiyet, 384 parsel sayılı taşınmazın 54,83 metrekarelik kısmında geçici irtifak kamulaştırma bedelinin tespiti ile tapunun DSİ Genel Müdürlüğü adına tescilini talep edildiği, işbu davaya karşı ilanen tebligatın yayınlanmasından itibaren 7 gün sonra tebliğ edilmiş sayılacağı ve taşınmazda hak iddia edenin konuya, taşınmaz değerine dair savunma ve delilini tebliğ tarihinden itibaren 10 gün içerisinde yazılı olarak sunulabileceği veya kendisini vekille temsil ettirebileceği, kamulaştırma bedelinin Bartın Vakıfbank Şubesine yatırılacağı, kamulaştırma ilanının tarihinden itibaren 30 gün içerisinde kamulaştırma işlemlerine karşı İdari Yargıda iptal davası, Adli Yargıda maddi hataya karşı düzeltim davası DSİ’ye karşı açılabileceği, İdari Yargıda iptal davası açanların 30 gün içinde dava açtığını ve yürütmeyi durdurma kararını sunmadığı takdirde kamulaştırmanın kesinleşeceği hususu;
Yine dava konusu taşınmaz başında yapılan keşif sonucu alınan 01/10/2024 havale tarihli Fen Bilirkişileri tarafından hazırlanan raporda ” Dava konusu Gerişkatırcı Köyü, 114 ada, 285 parsel sayılı taşınmazın tapu kaydında cinsi “kanal ve işletme bakım yolu”, 286 parsel sayılı taşınmazın tapu kaydında cinsi “tarla”, 383 parsel sayılı taşınmazın tapu kaydında cinsi “kanal ve işletme bakım yolu”, 384 parsel sayılı taşınmazın tapu kaydında cinsi “tarla” şeklinde rapor hazırlandığı,
Bilirkişi kurulunun 01/10/2024 havale tarihli raporunda “Dava konusu taşınmazların killi-tınlı bünyede %1-3 eğimlidir, %100 objektif değer artışının olduğu, kapitalizasyon faiz oranın % 4 olacağı, hissenize düşen kamulaştırma bedelinin tüm taşınmazlar bakımından toplam 31.545,38-TL olduğu” şeklinde rapor sunulduğu Bilirkişi raporlarına HMK 281. maddesi gereğince tebliğ tarihinden itibaren iki hafta içinde itiraz etmediğiniz taktirde bilirkişi raporuna itiraz etme hakkından vazgeçmiş sayılacağınız hususu”;
Mahkememiz dosyasının Duruşma Günü: 17/10/2025 günü saat: 09:40’da duruşmada bizzat hazır bulunmanız, veya kendinizi bir vekille temsil ettirmeniz, aksi takdirde yargılamaya yokluğunuzda devam olunacağı hususu ilanen tebliğ olunur.

FROM THE 5th CIVIL COURT OF FIRST INSTANCE OF BARTIN, TÜRKİYE

DEFENDANT: SERPİL BAYRAKTAR – 18400 Overlook Rd., Unit 66, Los Gatos, 95030 9988/ United States of America
In the case filed by the attorney of the General Directorate of State Hydraulic Works and registered under the above-mentioned case number before our court, it has been determined that you have a share in the following immovable properties located in Bartın Province, Central District, Gerişkatırcı Village: Block 114, Parcels 285, 286, 383, and 384, The plaintiff has requested: Ownership expropriation of 203.91 m² of parcel no. 285, Temporary easement expropriation over 78.96 m² of parcel no. 286, Ownership expropriation of 164.44 m² of parcel no. 383, Temporary easement expropriation over 54.83 m² of parcel no. 384, along with the determination of the expropriation value and the registration of the respective property rights in the name of the General Directorate of State Hydraulic Works in the land registry. It is hereby notified by public announcement that the notification will be deemed served 7 days after the publication of this notice. Any person claiming rights over the property may submit a written statement of defense and supporting evidence concerning the subject or the value of the property within 10 days from the date of notification, or may be represented by an attorney. The expropriation compensation will be deposited in the Bartin branch of Vakıfbank. It is also stated that, within 30 days from the date of the expropriation announcement, one may file: an action for annulment against the expropriation before the Administrative Court, or an action for correction of material errors before the Civil Court against the General Directorate of State Hydraulic Works. If a party fails to prove within 30 days that they have filed a lawsuit for annulment before the Administrative Court or does not submit a stay of execution decision, the expropriation process will become final.
Furthermore, in the expert report prepared by the Technical Experts with a referral date of 01/10/2024, following the on-site inspection ofthe immovable properties subject to the case, it was stated that: According to the land registry records: The nature of the immovable property located in Gerişkatırcı Village, block 114, parcel 285, is “canal and maintenance road”; The nature of parcel 286 is “field”; The nature of parcel 383 is “canal and maintenance road”;The nature of parcel 384 is “field”.
In the expert report submitted by the expert committee with a referral date of 01/10/2024, it was stated that: The immovable properties subject to the case have a clay-loam texture with a slope of 1-3%. There is a 100% objective increase in value, and the capitalization interest rate is determined to be 4%. The total expropriation compensation corresponding to your share for all the immovable properties is calculated as 31,545.38 Turkish Lira (TRY). It is also hereby notified that, in accordance with Article 281 of the Code of Civil Procedure, if no objection is made within two weeks from the date of notification, you shall be deemed to have waived your right to object to the expert report.
