Davacı İSMAİL UĞUR ile Davalılar SALİH BAYRAKÇEKEN, SERDAR ERGÜN, SALİH BAYRAKÇEKEN, ERDAL TÜFEKÇİ arasında mahkememizde görülen tapu iptali ve tescil davası nedeniyle;
Davanın, davacı şirket ve ortakları ile davalı şirket ortağı ve temsilcisi arasında muvazaa nedenine dayalı tapu iptali talebine ilişkin olduğu, davanın şirket sermayesi olan taşınmazın genel kurul kararı olmaksızın satılmasından kaynaklandığı ihtilafı ile Büyükçekmece 2. Asliye Hukuk Mahkemesi’nin 2009/767 Esas sayılı dosyası üzerinden açıldığı, mahkemece verilen görevsizlik kararı üzerine kararın istinaf aşamasından geçerek yargı yerinin mahkememiz olarak belirlenmesi sebebiyle yargılamaya mahkememiz esas üzerinden devam olunduğu, yargılama sırasında davalılardan SERDAR ERGÜN’ün Wevsvale Road San Diego 92129 9988 Amerika Birleşik Devletleri adresinde tebligat yapılamaması üzerine ilgiliye ilanen tebligat yapılmasına karar verildiği görülmekle;
Mahkememiz dosyasında duruşmanın 11/03/2024 günü saat: 09:40’a bırakıldığı gözetilerek, “duruşmada bizzat hazır bulunmanız, veya kendinizi bir vekille temsil ettirmeniz, geçerli bir özrünüz olmadan mahkemede hazır bulunmadığınız takdirde duruşmaya yokluğunuzda devam edileceği ve yapılan işlemlere itiraz edemeyeceğiniz” ihtaren ilanen davalı Serdar ERGÜN’e,
Tebliğ ile ihtarının yapılmış sayılacağı ilanen tebliğ olunur. 10/11/2023

Due to the title deed cancellation and registration lawsuit between the Plaintiff İSMAİL UĞUR and the Defendants SALİH BAYRAKÇEKEN, SERDAR ERGÜN, SALİH BAYRAKÇEKEN, ERDAL TÜFEKÇİ;
It is seen that the lawsuit is related to the request for cancellation of the title deed based on the reason of collusion between the plaintiff company and its partners and the defendant company partner and representative, with the dispute that the lawsuit arises from the sale of the immovable, which is the capital of the company, without the decision of the general assembly, and it was filed through Büyükçekmece 2nd Civil Court of First Instance through the file numbered 2009/767 Base, upon the decision of the court’s decision of non-jurisdiction, the trial was continued through our court due to the determination of the jurisdiction as our court by passing through the appeal stage of the decision, and during the trial, as the notification to the defendant SERDAR ERGÜN at the address of Wevsvale Road San Diego 92129 9988 United States of America could not be made it was decided to notify the interested party by announcement.
Considering that the hearing in the file of our court was left to 09:40 on 11/03/2024, you must be present in person at the hearing, or have yourself represented by an attorney, if you are not present in court without a valid excuse, the hearing will continue in your absence and you will not be able to object to the proceedings.
It is notified that the above warning will be deemed to have been made by announcement to the defendant Serdar ERGÜN
