Davacı tarafından aleyhinize açılan Ortaklığın Giderilmesi davasının yapılan yargılamasında;
Mahkememizce dava dilekçesinde belirtilen adresinize ve mernis (TORRANCE, CA 90504 /AMERİKA BİRLEŞİK DEVLETLERİ) adresinize dava dilekçesi ekli duruşma gününü bildirir davetiye çıkarılmış ise de tebligat yapılamamıştır, bu sebeple dava dilekçesi ve duruşma gününün, bilirkişi raporunun ve son duruşma zaptının ilanen tebliğine karar verilmiş ve ilan Alaturka İnternet Gazetesi’nin (Alaturka Online Newspaper) 14.08.2024 tarihli nüshasında yayınlanmıştır.
Bilirkişiler bilirkişi raporunda özetle dava konusu; İstanbul İli, Küçükçekmece İlçesi, Fatih Mahallesi, 1425 ada, 1 parselde kayıtlı taşınmazda yapılan incelemeler neticesinde imar mevzuati ve genel hükümler ile birlikte taraf sayısı nazara alındığında söz konusu taşınmazın taraflar arasında aynen taksiminin mümkün olamayacağı, takdiri Sayın Mahkemeye ait olmak üzere; şuyu’ un izalesinin ancak satılması ve satıştan elde edilecek bedelin hisseleri oranında paylaştırılması suretiyle giderilebileceği kanaatine varıldığını, dava konusu taşınmazın arsa ve üzerindeki yapının değeri; 19.12.2024 dava tarihi itibari ile 19.296.774,05 -TL olacağı, 15.09.2022 dava tarihi itibari ile 15.145.220,27-TLdeğerinde olduğu görüşünü mahkememize bildirmiştir.
Mahkememiz dosyasında son duruşma 07/10/2025 Tarihinde yapılmıştır.
Durusma Günü: 14/04/2026 günü saat: 09:35’da duruşmada bizzat hazır bulunmanız, veya kendinizi bir vekille temsil ettirmeniz, Aksi taktirde HMK’nın 137. maddesi uyarınca yargılamaya yokluğunuzda devam olunacağı ve HMK’nın 281. Maddesi uyarınca tebliğinden itibaren rapora iki haftalık kesin süre içerisinde itiraz edebileceğiniz hususu, bilirkişi raporu yerine geçerli olmak üzere ilanen tebliğ olunur.

In the trial of the Partnership Dissolution case filed against you by the plaintiff;
Although a summons with the hearing date attached to the petition was issued by our Court to the address specified in the petition and to your MERNIS (TORRANCE, CA 90504 / UNITED STATES OF AMERICA) address, service could not be affected. For this reason, it was decided to serve the petition, the hearing date, the expert report, and the minutes of the last hearing by announcement, and the announcement was published in the August 14, 2024 issue of Alaturka Internet Gazetesi (Alaturka Online Newspaper).
In summary, the experts stated in their report that, as a result of the examinations conducted on the immovable property registered in Istanbul Province, Küçükçekmece District, Fatih Neighbourhood, Block 1425, Parcel 1, considering the zoning legislation and general provisions along with the number of parties, it is not possible to divide the said immovable property in kind among the parties. They opined that, subject to the discretion ofthe Honorable Court, the dissolution of the joint ownership can only be achieved by selling the property and distributing the proceeds from the sale in proportion to the shares (İzale Şuyu). They notified our Court that the value of the subject immovable property as land and the structure thereon would be 19,296,774.05 TL as of the case date of December 19, 2024, and 15,145,220.27 TL as of the case date of September 15, 2022.
The last hearing in our Court’s file was held on October 7, 2025.
Hearing Date: You are required to appear in person at the hearing on April 14, 2026, at 09:35, or to be represented by an attorney. Otherwise, pursuant to Article 137 of the Code of Civil Procedure (HMK), the trial will proceed in your absence, and pursuant to Article 281 of the HMK, you may object to the report within a definitive period of two weeks from the date of service. This announcement serves in place of the expert report and is served by publication.
